The National Bank of Serbia once again emphasises that the latest amendments to the Law on Foreign Exchange Operations in December 2012 carved out all legal obstacles for international payments to be carried out through the PayPal service.
Article 32 of the Law stipulates that residents may perform international payment transactions in foreign exchange through an e-money institution for the purpose of purchasing and selling goods and services with non-residents. It also sets out that residents’ funds kept with PayPal shall not be considered a deposit, but shall be recorded on a subaccount opened with this institution for the purpose of conducting electronic purchase/sale of goods and services.
Given the above, the NBS highlights that PayPal is exempt from verifying participants in sale and purchase transactions performed in the Republic of Serbia as residents carry the responsibility for any euro collections made against other residents. Namely, in performing these transactions, residents must act in accordance with Serbian legislation and make payments and collections through PayPal only with non-residents.
The NBS also underlines that the Ministry of Finance – Tax Administration, is responsible for the oversight of resident FX operations in accordance with regulations governing this field.
