Measures taken in supervisory proceedings

Pursuant to Article 118 of the Law on Banks (RS Official Gazette, Nos 107/2005, 91/2010, 14/2015 and 19/2025), the NBS hereby publishes a notice on the measures taken in supervisory proceedings concerning the legality of the operations of ProCredit Bank a.d. Beograd.

The NBS issued to ProCredit Bank a letter of warning, establishing that ProCredit Bank engaged in an aggressive commercial practice within the meaning of Article 21 and Article 22, paragraph 1, item 3) of the Law on Consumer Protection (RS Official Gazette, No 88/2021), which is prohibited under Article 16, paragraph 1 of that Law. Namely, Procredit Bank ran an advertising campaign via the Rakuten Viber application, whereby a message link reading “Take out a loan” was sent whenever users, in private communications conducted through that application, typed certain words such as loan, instalment, salary, expenses.

Given that ProCredit Bank discontinued the disputed advertising campaign a few days after its launch, the said letter of warning prohibits ProCredit Bank from creating and disseminating advertising messages whose characteristics correspond to the unfair commercial practice identified in that warning. ProCredit Bank was also ordered to undertake certain activities aimed at improving the training of employees responsible for creating advertisements and making decisions on advertising.  

Moreover, it was established that the warning “Caution! Borrowing money costs money” was not displayed appropriately in accordance with Article 17, paragraph 2 of the Law on the Protection of Financial Service Consumers (RS Official Gazette, No 19/2025), and ProCredit Bank was therefore also ordered to take specific measures in relation to this irregularity.

Alongside the letter of warning, ProCredit Bank was also imposed a fine in accordance with Article 117 of the Law on Banks (RS Official Gazette, Nos 107/2005, 91/2010, 14/2015 and 19/2025).
