New NBS Decision on Revocation of Astra Bank Operating License

For the ninth time in a row, the National Bank of Serbia brought the decision on the revocation of the Astra bank operating license. On September 16, the Supreme Court repealed the previous NBS decision on the revocation of the operating license of this bank.

In the repeated procedure, taking into consideration the legal understanding of the Supreme Court of Serbia, and in respect of the regulations related to the NBS supervision function determined by the Law, the National Bank of Serbia revoked again the Astra bank operating license, which implies the prohibition of disposing of the Bank’s property until the adoption of the decision of the competent court on the instigation of the liquidation procedure. The Law on Bankruptcy and Liquidation of Banks and Insurance Companies stipulates, on the basis of the revocation of the operating license, that the NBS shall immediately bring the decision on bank liquidation, which was exactly what the NBS did by adopting the decision and submitting it yesterday to Astra bank, competent court and Deposit Insurance Agency.

The NBS would like to warn once again that the successive court repeal of the NBS decision on the revocation of the Astra bank operating license damages debtors to the greatest extent as their real possibilities for the collection of claims in respect of this bank are significantly diminished.
